The heart of the arbitral process.

A common problem faced in respect of arbitration agreement is that insufficient pre-emptive thought goes into the drafting of the agreement.
For the practitioner, it is important to think ahead in drafting an arbitration agreement and to get as much agreed (to your client’s benefit) as possible at an early stage, before a dispute arises. Most arbitral institutions have their own model arbitration clauses. These are helpful and should be used, but they will usually need supplementing with additional provisions. Before examining the arbitration agreement in detail, let’s consider the issue of what sort of disputes may properly be resolved by way of arbitration.
