One matter that sometimes taxes lawyers in an international arbitration is the position on legal professional privilege. The law varies from jurisdiction to jurisdiction, not just as to the nature of privilege (or, indeed, where the privilege as such actually exists), but as to who is subject to that privilege.

For example, in Germany and may other civil law jurisdictions, there is deemed to be not a lawyer-client relationship between an in-house lawyer or general counsel and any other member of the company’s staff.
