This course aims to develop critical awareness of the factors influencing the choice of an appropriate procurement strategy.

This program will teach you to identify risks around contracts and procurement

This program aims to develop your understanding of the selection, use and interpretation of standard forms of contracts within the construction industry. We’ll also cover procurement methods, tendering procedures and the contractual relationships among project participants.

In addition, you’ll have the opportunity to form awareness of the main standard forms of contract available within the industry and gain a broader understanding of the legal framework within which construction firms and projects are managed.

Learning outcomes

On successful completion of this program, you should be able to:

  • Appraise contractual provisions and subcontracting mechanisms, assess general contractual provisions such as letters of intent, insurance, retention, bonds, liquidated damages, early possession, practical completion and other contractual mechanisms

  • Evaluate contractual risk and procurement routes (traditional, design and build, management, partnering, private finance initiative and prime contracting)

  • Appraise detailed provisions and requirements of the JCT 2016 and NEC3 ECC family of contracts to a particular scenario or case study

  • Advise parties to a contract of their contractual rights, liability and obligations

  • Appraise the basic contractual mechanisms and procedures at both pre and post-contract stages of construction and relate the principles of the formation of a contract in English law

  • Evaluate and apply administrative mechanisms of various forms of contract in construction scenarios with critical awareness of its characteristics and evaluation of the roles and obligations of parties to the contract in addition to the role of the contract administrator
